SALES POLICY
- 1.Β Wholesale and Retail.
ForbestΒ Products Co. (βForbestβ) sells products for business use to resellers and end users with proper business identification, which is required from all customers prior to purchase.Β ForbestΒ reserves the right to accept or reject any order.
- 2.Β Prices
Prices are listed without including freight, handling fees, taxes, and/or duties, and are subjected to correction or change without notice. Market sensitive commodity products will be priced according to current market conditions. Customer should contact the localΒ ForbestΒ branch (US and Canada Location) or check online atΒ www.forbestcanada.comΒ for current pricing.
- 3.Β Sales Tax
Customers are responsible for payment of all applicable state and local taxes, or for providing a valid sales tax exemption certificate.
- 4.Β Payment
ForbestΒ accepts cash, checks, money orders, wire transfer, Visa and MasterCard. All payment must be made in U.S. dollars if the items are shipped from U.S. branch and all payment must be made in Canadian dollars if the items are shipped from Canada branch.
Customer agrees to assume responsibility for, and customer hereby unconditionally guarantees payment of, as provided herein, all purchases made by customer, its subsidiaries and affiliates. Each of customer's subsidiaries and affiliates purchasing fromΒ ForbestΒ will be jointly and severally liable for purchases with customer, and customer is also acting as agent for such subsidiaries and affiliates.
- 5.Β Credit Balance
Customer agrees that any credit balance byΒ ForbestΒ will be applied to customerβs account within three (3) months of its issuance.
- 6.Β Cancellation
All product order cancellations must be approved byΒ Forbest, and may be subject to restocking fees and other charges.
- 7.Β Custom Product
ForbestΒ may offer products manufactured or assembled to customers specifications (βCustom Products(s)β) according to customers' request. Within fifteen (15) days of receiving the custom product, the customer must report toΒ ForbestΒ in written form if they are not satisfied with the custom product. If there are not any feedbacks in written form after fifteen (15) days,Β ForbestΒ regards that the customer is satisfied with the custom product.Β ForbestΒ One-Year Limited Warranty terms do not cover the loss for the design shortcomings of the custom product. All Custom Products are sold on a βFINAL SALEβ basis only, and no cancellations, returns, refunds or credits are allowed, except that the custom product has the major defects of manufacturing.Β
FREIGHT POLICY
All orders, whether for parts or whole camera system are shipped F.O.B.Β ForbestΒ Products Co. in California in us orΒ ForbestΒ Products Co.(Canada) in Ontario in Canada. Freight and transportation as well as freight and transportation insurance are the customerβs sole responsibility.Β ForbestΒ will insure all shipments for the maximum invoice amount.
C.O.D. shipments are not permitted. GenerallyΒ ForbestΒ deliver products by UPS in US and by UPS or Canada Post in Canada. Other courier service is possible but extra charge may be needed. A physical street address is required for all addresses and PO Box is not acceptable for delivery. Adult signature is needed for the confirmation of the receipt of products. In case that the customer asks for changing the address after the order is shipped out, customer will pay for the cost of address change.
BasicallyΒ ForbestΒ deliver items to US customers from US branch and to Canada customers from Canada branch. In the event that there is no stock and customers need the product urgently, we may deliver items by international shipping. Import duties, taxes and brokerage charges areΒ NOT INCLUDED in the item price or shipping charges. These charges are the buyerβs responsibility. These charges are normally collected by the delivering shipping company or when you pick the item up. Please do not confuse them for additional shipping charges.
WARRANTY POLICY
- 1.Β SATISFACTION GUARANTEE TO ALL CUSTOMERS: 30-DAY MONEY BACK POLICY
Customers should contactΒ ForbestΒ if they are not satisfied with a product for any reason within 30 days of the invoice date. A 30-day Money Back is guaranteed (Shipping & Handling and other additional charges, such as the transaction fee 6% of the total amount charged by bank or Credit Card Company, are not refundable). However, Returned product must be in original packaging, unused, undamaged, and in saleable condition. Proof of purchase is required in all cases. The 30-Day Money Back Policy does not apply the custom product.
- 2.Β LIMITED WARRANTY
All products sold are warranted byΒ ForbestΒ only to customers for: (i) resale; or (ii) use in business, government or original equipment manufacture.Β ForbestΒ warrants products against defects in materials and workmanship under normal use for a period of ONE (1) year the date of purchase fromΒ Forbest, unless otherwise stated. Should the customer have any problem about theΒ ForbestΒ product, the customer should contact the dealer orΒ ForbestΒ immediately.Β ForbestΒ will not cover the defective items in warranty term after the product has been repaired by a third party even if it is within 1 year since the purchased date.
During the limited warranty period,Β ForbestΒ may, at its option: (i) repair; (ii) replace; or (iii) refund the amount paid by customer. Customer must return the product to the appropriateΒ ForbestΒ branch or authorized service location, as designated byΒ ForbestΒ and pay for the shipping cost.Β ForbestΒ will cover the shipping cost for the return of the product to customers in 46 states of US and in Canada within the warranty term. For a RMA item from other offshore regions (Hawaii, Alaska, Puerto Rico, and the U.S. Virgin Islands) and countries outside of US and Canada, the customer has to pay all the shipping including the return shipping fromΒ ForbestΒ and tax, if any, even for an item within the warranty term. In the event that there are import charges and brokerage charges in processing repair or replacement of warranted items, the incurred import charges and brokerage charges will be undertaken by the importer regardless of either party.
- 3.Β Warranty Return
Before retuning any product, customer shall: (i) write or call the localΒ ForbestΒ branch from which the product was purchased; (ii) fill in theΒ ForbestΒ RMA form and provide the date, the original invoice number, the stock number, and the description of the defect (iii) or report to the dealers and ask them to contact us. Proof of purchase is required in all cases.
For those returned items exceeding over 6 months,Β ForbestΒ will send an emal or call the customer after 6 months to remind the customer and the customer should get back toΒ ForbestΒ within 5 business days. Otherwise,Β ForbestΒ has the right to dispose of the returned items at its own will without undertaking any cost or responsibility.
Β Β Β 1.4Β Repair
For items that have been repaired, we warranty the repair for 30 calendar days since the delivery of the returned package to customers. For the repair of over 30 days, we need to charge the parts and labor cost for the new repair
